– General Terms and Conditions
1. Scope of application
These General Terms and Conditions apply to all services provided by CityCar Stuttgart in the area of chauffeur and car rental services to businesses and consumers.
Deviating terms and conditions of the customer shall not apply unless CityCar Stuttgart has expressly agreed to their validity in writing.
2. Object of the Contract
CityCar Stuttgart provides chauffeur-driven passenger transport services.
Types of Performance
- Transfer trips (e.g., airport, city)
- Time bookings
- City-to-City Trips
The specific scope of services is determined by the respective booking or offer.
3. Conclusion of Contract
Inquiries made via the website, phone, or email represent a non-binding offer from the customer. A contract is only concluded upon confirmation of booking by CityCar Stuttgart (in writing, by email, or by any other electronic means).
The customer is obliged to check the details in the booking confirmation and to report any discrepancies immediately.
4. Prices and Billing
All prices are understood Net plus statutory VAT, unless otherwise noted.
The prices agreed upon at the time of booking apply.
Additional costs can arise from:
- Additional kilometers beyond the included distance
- Wait times
- Additional stops or changes
- Night shift differential
5. Waiting time
- 60 minutes wait including airport pickups
- 15 minute wait on all other trips included
After that, waiting time will be charged according to the price list, billed per commenced half-hour.
6. Time Bookings
- Minimum booking: 2 hours
- Including 12.4 mph
- Extra kilometers are calculated separately
Usage time begins at the agreed starting point. Bookings must end in the same city or metropolitan area as the pickup location; otherwise, a vehicle return fee will apply. The return fee will be calculated based on the kilometer rate of the booked vehicle class according to the price list (additional kilometers), related to the return trip of the vehicle to the Stuttgart metropolitan region.
7. City-to-City Trips
- Prices are based on fixed routes or mileage billing
- Additional charges will be applied for deviations (detours, extra stops).
- Return trips are not automatically included.
Return trips are arranged separately. If the same customer books the return trip, a reduced price may be offered; if a different customer books it, the full route price applies.
8. Night shift differential
For trips between 10:00 PM and 6:00 AM will a surcharge of 15 % charged to the basic price.
9. Payment Terms
Payment via:
- Invoice (Bank Transfer)
- Payment link / Credit card
- Payment terms: according to agreement
If the customer is in default of payment, the statutory default interest (§ 288 BGB) shall apply. CityCar Stuttgart reserves the right to charge actual reminder costs.
10. Cancellation policy
- Cancellation until 24 hours before departure: free of charge
- 24–12 hours beforehand: 50 % of the fare
- Less than 12 hours or no-show: 100 % of the fare
The customer is free to prove that CityCar Stuttgart incurred no damage or substantially less damage than the aforementioned flat fee. In this case, only the proven, lower amount will be charged.
11. Customer No-Show
If the customer does not appear at the agreed pick-up location:
- After the included waiting time has expired, the trip is considered completed.

12. No right of withdrawal
For contracts for the carriage of passengers that provide for a specific date or period for the performance of the service, there is no right of withdrawal under § 355 BGB (§ 312g para. 2 no. 9 BGB). Only the cancellation conditions according to §10 apply. 13. Delays and Changes
Customer delays are at the customer's expense.
Changes must be communicated in a timely manner.
Additional costs due to changes, e.g., destination, stops, additional waiting time, will be charged. Additional stops will be charged as waiting time (see §5).
14. Duty of Performance
A confirmed booking is binding.
CityCar Stuttgart is entitled to use an equivalent replacement driver or subcontractor in exceptional cases.
15. Vehicles
There is no entitlement to a specific vehicle model.
A vehicle of the booked category or equivalent will be provided.
16. Subcontractor
CityCar Stuttgart is authorized to pass on orders to qualified partners.
The quality standards remain maintained.
17. Liability
CityCar Stuttgart is liable without limitation for damages arising from injury to life, limb, or health based on an intentional or negligent breach of duty, as well as for other damages based on intent or gross negligence.
CityCar Stuttgart shall be liable for the breach of essential contractual obligations (cardinal obligations), the fulfillment of which is essential for the proper performance of the journey and on which the customer may regularly rely, even in cases of simple negligence, limited to the damage foreseeable at the time of concluding the contract and typical for the contract.
Furthermore, liability for simple negligence is excluded. In particular, to the extent not otherwise provided for above, there shall be no liability for:
- Traffic delays
- Force majeure
- Flight delays (considered, but without guarantee)
Open point: fixed maximum amount for material damage (analogous to competitive comparison) not yet finally decided.
18. Vehicle Conduct
Smoking ban in all vehicles.
Damage or heavy soiling will be charged.
CityCar Stuttgart is entitled to refuse or cancel a ride if a passenger is visibly intoxicated, aggressive, or poses a safety risk. The claim for remuneration remains unaffected by this.
19. Customer's Duty to Cooperate
The customer is obligated to:
- to provide correct information
- to be reachable
- to show up at the pickup location on time
20. Data Privacy
CityCar Stuttgart processes customer's personal data exclusively within the scope of legal provisions (GDPR). Further information can be found in the privacy policy at citycar-stuttgart.com.
21. Jurisdiction
The place of jurisdiction is Stuttgart, if legally permissible.
22. Severability Clause
Should individual provisions be ineffective, the validity of the remaining regulations shall remain unaffected.
